Rules Review as Required by House Bill 74
In accordance with State Law (House Bill 74), which passed in the 2013 Session of the North Carolina Legislature, all state agencies, including occupational licensing boards, must review their existing rules every ten years “to make sure the rules are still necessary and within the agency’s authority and address programs that still exist.” The first step in this process involves identifying each rule as: (1) necessary with substantive public interest; (2) necessary without substantive public interest; or (3) unnecessary. Definitions for each of these classifications, as established by the Rules Review Commission of the Office of Administrative Hearings, are located on the Rules Review Commission website.
The North Carolina State Board of Environmental Health Specialist Examiners reviewed its rules, NCAC Title 21 Occupational Licensing Boards and Commissions, Chapter 62 Environmental Health Specialist Examiners on July 18, 2014. A spreadsheet that lists the Board’s thirteen Rules and their corresponding determinations is available here. For full text of the Rules, click here.
The Environmental Health Specialist Examiners Board will accept written comments objecting to all or any part of the rules from any member of the public, including an association or other organization representing the regulated community or other members of the public, until September 26, 2014. In order for the Rules Review Commission (RRC) to consider a comment, the comment must address the content of the rule.
